Massachusetts Lawmakers Remove Proposed Ban On Competitive Electric Market From Climate Bill

Consumers and companies thank legislators for protecting the energy choice of half a million customers

July 25, 2022 (BOSTON) – Lawmakers working to combine House and Senate energy bills decided to scrap their plan to end the retail electric market throughout the state, a move that would have reinstated electric utility monopolies.

The news comes only a week after more than 1,200 Massachusetts residents signed a petition in opposition to the measure. Nearly half a million Bay State households exercise their energy choice and shop the retail market.

Many expressed concern that they would no longer be able to sign up for clean energy plans or would lose their ability to shop for the best electricity rates and fixed-rate contracts. Others objected that ending competition would remove the utilities’ incentive to compete through lower prices and better service.

“The proposed closure of the competitive energy market was at odds with the intent of this climate bill as more than three quarters of the retail market offerings are 100% clean energy products with additional innovative products supporting energy efficiency measures and offering discounted residential electric vehicle charging,” said Chris Ercoli, President and CEO of the Retail Energy Advancement League.

“We appreciate lawmakers acting on behalf of almost half a million Massachusetts customers who currently shop the market by removing this language and we look forward to continued conversations on how to best expand choice, while protecting the consumer as Massachusetts leads in our transition to a clean energy future.”

In a recent survey, 83% of Bay Staters said they want energy choice and to shop the market as an option. Energy Choice Took Center Stage At Macruc Annual Education Conference

Last week REAL and many of its members gathered for the MACRUC 27th Annual Education Conference. MACRUC, or the Mid-Atlantic Conference of Regulatory Utility Commissioners, helps promote the region-wide advancement of public utility regulation and the related regulatory, legislative and policy interests of MACRUC members. And yes, this does include energy choice.

In fact, the opening general session, Retail Competition in the Mid-Atlantic: Challenges, Opportunities and the Road Ahead, put energy competition front and center. REAL member Travis Kavulla, Vice President of Regulatory Affairs for NRG and Kristina Montgomery, Director of Retail Policy for Vistra Energy, were joined by the Honorable Jason Stanek, Maryland, Patrick Cicero, Consumer Advocate for Pennsylvania, and Robert Powelson, President and CEO of National Association of Water Companies.

Kavulla laid out the three reasons why energy choice is more important now than ever before: the volatility of world energy markets, new technology responding to demand and flexible retail helps tap into emerging technologies and increased customer demand for green, clean energy.

Montgomery made the excellent point that retailers have to fight to keep their customers every single day, reminding the audience, customers can leave, ratepayers cannot. She also highlighted another benefit of energy choice: competition can facilitate the transition to a clean energy economy and makes clean energy accessible to customers who may not be able to install their own solar panels.

Powelson, who was instrumental in opening PA markets during his tenure on the PUC, had what REAL member Clean Choice Energy’s Vice President General Counsel Jennifer Spinosi called a ‘mic drop’ moment, when he said “The competitive market on its worst day is better than the regulated market on its best.”

Conversations about EV charging infrastructure, clean energy transitions and corporate responsibility were also taking place throughout the conference, all hallmarks of the benefits that arise when there are competitive energy markets helping to move the conversations into areas that truly matter to energy consumers.

One of the final sessions, the State of the States, where commissioners from MACRUC member states talk about the past year and focus areas for the coming year, highlighted the importance of the work each state is doing to make it easier to incorporate clean energy into existing infrastructure, and how they can make it accessible to more and more people.

The conference came to a close with the installation of 2022 – 2023’s new MACRUC leadership: President Gladys Brown Dutrieuille, Pennsylvania Public Service Commission, First Vice President, Kent Chandler, Kentucky Public Service Commission, Second Vice President, Diane Burman, New York Public Service Commission, Secretary-Treasurer Kim Drexler, and Delaware Public Service Commission.

Abby Foster Joins Retail Energy Advancement League As Vice President, Policy And Advocacy

Abby Foster has joined the Retail Energy Advancement League (REAL), a non-partisan retail energy organization, to help lead their efforts to open, maintain and optimize competitive retail energy markets.

Foster joins REAL from BRAVO Group, where as Senior Director she directed strategic communications and lobbying campaigns to effect change in public policy. She has spent the last 15 years building and engaging communities to advocate for issues that span political parties and industries with much of her career focused on energy and infrastructure.

Chris Ercoli, President, and CEO of REAL, knows adding Foster will have an immediate, positive impact to the REAL team. “Our entire goal as an organization is to move minds and markets toward consumer choice, and I cannot think of a person better qualified to do that than Abby Foster. She has an incredible track record organizing successful issue campaigns and she’s bringing that experience and enthusiasm to help REAL make an impact.”

Foster was also the President of the Pennsylvania Chemical Industry Council (PCIC). In her role, Foster worked with lawmakers and regulators to improve the business climate and allow companies to succeed. PCIC works to attract opportunities to grow the regional markets and associated supply chains.

REAL recently announced the formation of its national advocacy organization aimed at modernizing the retail energy markets. REAL is a coalition of companies that believe consumers deserve control over their energy decisions, including how to buy, produce and consume energy, energy services, usage data, and other energy insights.
